Basson Workwear Werksdrag (Pty) Ltd, trading as Basson Workwear (“we”, “us” or “our”), respects your privacy. This policy explains how we collect, use, share, retain and protect personal information received through our website and customer communications.

It applies to website visitors, customers, business contacts and people whose information is supplied for an order. We process personal information in accordance with South Africa’s Protection of Personal Information Act 4 of 2013 (“POPIA”).

Personal information includes information relating to an identifiable living person and, where applicable under POPIA, an identifiable existing business or other juristic person.

Reading this policy or using our website does not, by itself, constitute consent to optional marketing or tracking.

    1. Information we collect

    Information you provide

Depending on your interaction with us, we may collect:

    • Your name, business name, email address and telephone number.
    • Billing and delivery addresses, order details and invoice information.
    • Purchase history, payment confirmations and transaction references.
    • Garment sizes, names for personalisation, employee or department packing lists, artwork and branding instructions.
    • Account information, preferences, enquiries, correspondence and feedback.

Please provide accurate, current information and notify us of relevant changes. Only supply information necessary for your request.

Do not send us card PINs, passwords or one-time codes. Avoid supplying identity documents or other sensitive information unless we have explained why it is necessary and how to provide it safely.

    Information supplied by someone else

An employer, purchasing representative, parent or other authorised person may provide information about people receiving garments or personalised products.

If you provide someone else’s personal information, you must have a lawful basis to share it and make them aware of this policy. We remain responsible for meeting our own obligations under POPIA.

Names, sizes and other details supplied for an order are used to fulfil that order and provide related support. Supplying these details does not automatically subscribe the individuals concerned to marketing.

    Information collected through the website

Our website may collect technical and usage information, including:

    • IP addresses and browser or device information.
    • Referring pages and pages visited.
    • Shopping-cart activity and interactions with the store.
    • Cookie identifiers and similar online identifiers.

Technical information may constitute personal information, particularly when linked to an account or other identifying details.

    Information received from service providers

Shopify, payment providers, couriers and other fulfilment providers may supply information needed to manage your purchase, such as transaction references, payment status and delivery updates.

Payment information is processed through the payment options offered at checkout. Payment providers may process information under their own privacy policies.

    2. Required and optional information

Certain information is necessary to prepare quotations, process payments, issue invoices, arrange deliveries or complete manufacturing and branding.

If you do not provide information needed for a request, we may be unable to fulfil it or may need to discuss another arrangement. Where information is required by law, we will explain this when relevant.

Optional information and marketing consent are voluntary. You do not have to agree to marketing to purchase from us.

    3. How we use personal information

We use personal information for purposes such as:

    • Responding to enquiries and preparing quotations.
    • Creating and managing customer accounts where available.
    • Processing orders, payments and refunds.
    • Arranging manufacturing, embroidery, printing and other branding.
    • Completing personalisation and agreed packing requirements.
    • Arranging collection and delivery.
    • Sending invoices and order updates.
    • Managing returns, warranties and complaints.
    • Maintaining business records and meeting legal obligations.
    • Protecting our website and business against fraud and misuse.
    • Understanding website use and improving our services.
    • Sending promotional communications where legally permitted.

We only process personal information where POPIA permits it. Depending on the circumstances, processing may be necessary to enter into or perform a contract, comply with a legal obligation, protect a legitimate interest recognised by POPIA, or act with your consent.

If we propose using information for a different purpose, we must first establish that the use is compatible with the original purpose or otherwise permitted by law. We will provide any additional notice or obtain any consent required.

    4. Cookies and similar technologies

Cookies are small files used to support website functionality. Some help maintain shopping carts, account access and security.

Where enabled and lawfully used, other cookies or similar technologies may support website analytics or advertising. The information collected depends on the tools operating on our website.

You can manage cookies through your browser settings and any cookie-preference controls available on the website. Blocking essential cookies may affect store functionality.

Where consent is required for optional tracking, it must be obtained before that tracking takes place, and your preferences must be respected.

Further information about Shopify’s cookies is available at Shopify’s Cookie Policy.

    5. When we share information

We may share information where necessary with:

    • Shopify and providers hosting, maintaining or supporting the online store.
    • Payment providers and financial institutions processing payments or refunds.
    • Couriers and logistics providers.
    • Suppliers, manufacturers, embroidery teams and other branding partners.
    • IT, communication and professional service providers.
    • Authorities or other parties where disclosure is required by law or otherwise lawfully necessary to protect legal rights.

For personalised or bulk orders, production partners may need names, garment sizes, artwork or packing instructions. Information shared must be limited to what is necessary for the task.

Providers processing information on our behalf must be subject to the confidentiality and security arrangements required by POPIA. Some providers also have independent legal responsibilities and their own privacy policies.

We do not sell personal information.

If a proposed sale, merger or restructuring of our business requires disclosure or transfer of customer information, it must have a lawful basis and appropriate safeguards. Applicable notification requirements and privacy rights will continue to apply.

    6. Marketing communications

We send promotional emails or other electronic marketing where you have provided the required consent or where POPIA’s existing-customer exception applies.

Where we rely on that exception, we must have obtained your contact details in connection with a sale, market our own similar products or services, and provide a reasonable opportunity to object when collecting your details and in each marketing communication.

You may unsubscribe at any time, free of charge, using the unsubscribe option provided or by emailing info@bassonworkwear.co.za.

We may retain a limited record of your objection to ensure that we honour your preference.

Unsubscribing from marketing does not prevent necessary communications about an order, payment, delivery or service request.

    7. Reviews, artwork and public content

If you submit a review or other material for public display, do not include confidential information or another person’s personal information without appropriate authority.

We must have a lawful basis to publish personal information. Providing artwork, photographs, names or branding instructions to complete an order does not, by itself, authorise their use in our public marketing materials.

Private enquiries are handled in accordance with the purposes and lawful disclosures described in this policy.

    8. Information security

We must maintain reasonable technical and organisational safeguards to protect personal information against loss, unauthorised access, destruction and unlawful use.

Access must be limited to people who need the information for authorised work. Security measures must be reviewed as risks and business processes change.

Although reasonable safeguards are required, no website, electronic transmission or storage system can guarantee complete security.

Please contact us promptly if you suspect unauthorised use of your account or misuse of information connected with an order.

Where there are reasonable grounds to believe personal information has been accessed or acquired by an unauthorised person, we must notify the Information Regulator and affected people as soon as reasonably possible after discovery, subject to POPIA’s exceptions and permitted delays. Required notices must help affected people understand the incident and take protective steps.

    9. Retention and account closure

We retain personal information only for as long as necessary for its lawful purpose, or as required or permitted by law.

Retention periods depend on factors such as:

    • Outstanding quotations, orders and customer relationships.
    • Tax, accounting and other legal recordkeeping obligations.
    • Returns and warranty requirements.
    • Disputes, investigations and the protection of legal rights.

You may request account closure or deletion of information. Closing an account does not automatically remove records that we must or may lawfully retain.

When information is no longer needed and there is no lawful reason to retain it, it must be securely deleted, destroyed or de-identified.

Information lawfully retained in backups or restricted archives must remain protected and must not be used for unrelated purposes.

    10. Information processed outside South Africa

Shopify and other service providers may process personal information in countries outside South Africa. Those countries may have different privacy laws.

Cross-border transfers must comply with POPIA. This may involve a recipient subject to adequate protection under law or binding arrangements, or another transfer basis permitted by POPIA.

Contact us if you would like information about the recipients, destinations and safeguards relevant to your personal information.

Further information about Shopify’s practices is available at Shopify’s Privacy Policy.

    11. Children’s information

Purchases should be handled by an adult. We do not knowingly seek children’s personal information directly for marketing.

Where a personalised or school-related order requires a child’s details, only information necessary for the order should be supplied.

Processing must be authorised by a competent person, such as a parent or legal guardian, or fall within another applicable exception under POPIA. An adult placing an order is not automatically authorised to provide that permission.

Please contact us if you believe a child’s information has been supplied without the necessary authority.

    12. Your privacy rights

Subject to POPIA and other applicable law, you may:

    • Ask whether we hold personal information about you and request access to it.
    • Request correction of inaccurate or incomplete information.
    • Request deletion of information we are no longer entitled to retain.
    • Object to processing where POPIA gives you that right.
    • Withdraw consent where processing relies on consent.
    • Object to direct marketing.
    • Lodge a complaint with the Information Regulator.

Withdrawing consent does not affect processing that was lawful before withdrawal or prevent processing supported by another lawful basis.

Send requests to info@bassonworkwear.co.za with “Privacy Request” in the subject line. You may also use this address to request account updates or closure.

We may require reasonable proof of identity or authority to act on another person’s behalf. We will explain what is necessary and avoid requesting more identifying information than needed.

We will explain the applicable process, any fee permitted by law and any lawful reason preventing us from fully meeting a request.

    13. External websites

Our website may contain links to websites operated by other organisations.

Their privacy practices may differ from ours. Please review their privacy notices before providing personal information.

    14. Contact details and complaints

    15. Changes to this policy

We may update this policy to reflect changes in our operations, services or legal requirements. The latest version will appear on our website with an updated date.

Where a change requires additional notification or consent, we must provide that notification or obtain that consent. Updating this policy does not, by itself, authorise a new use of personal information.
